Cover for liabilities, losses, costs and expenses such as
The cover excludes liabilities, losses, costs and expenses in respect of damage to or loss or reduced value of Cargo arising as a consequence of a condition, quality or specification of the Cargo which existed prior to the Cargo being accepted for carriage or which was caused by treatment or processing, including blending, of Cargo other than treatment necessary for transportation.
Assured(s)’ own Cargo, extra handling costs and general average exclusion. All liabilities, losses, costs and expenses relating to Cargo intended to be, or being or having been carried on the Ship as specified in Rule 34, liabilities relating to handling, discharging or disposing of the Cargo as specified in Rule 35 and relating to general average as specified in Rule 41, are excluded from cover where such Cargo is owned by the Assured(s) or a Co-assured or any person affiliated to or associated with the Assured(s) or the Co-assured, and Rule 50.b shall not apply.
This additional cover is available for cargo owners and traders who have underlying Comprehensive Charterers' cover with Gard. The cover is designed to extend the charterer's cover to the assured in the capacity of a cargo buyer, seller or bill of lading holder. The cover can be extended to vessels that are not chartered and only carry the assured's cargo.
Liabilities covered can include damage to the hull caused by cargo traded by the assured (whether contractual or in tort), damage to berth/terminal/other property caused by cargo and certain contractual liabilities. Further, the cover is available for all risks covered under the Comprehensive Charterers’ Cover, including personal injury, pollution, damage to property, and wreck removal (including removal of cargo).
