This circular outlines amendments to the Rules for Ships and the Rules for Mobile Offshore Units (MOUs) of both Assuranceforeningen Gard - gjensidig - and Gard P. & I. (Bermuda) Ltd, which will enter into force at noon GMT on 20 February 2013.

Since many owners will be signing new spill response contracts with SPROs in the near future, a revised set of FAQs taking account of the revised Detailed Rules have been issued as contained in Annex I to this circular in advance of any further MSA Notice. Attached is also the Sample Agreement dated 20 November 2012.

For vessels registered in a non EU/EEA State, Germany has agreed to issue certificates to vessels registered in non EU/EEA States if they are calling at any EU port, and not just German ports, and that a number of EU/EEA States will issue certificates to such vessels if calling at a port in their State after 31 December 2012, including the United Kingdom, France, Spain, Netherlands, Poland, Cyprus, Belgium and Sweden.

Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the Liability of Carriers of Passengers by Sea in the Event of Accidents will take effect on 31 December 2012. The Athens Convention will therefore enter into force after the Regulation takes effect.

On 14 September, the China MSA issued revised Detailed Rules on the Implementation of the Administration Regime of Agreement for Ship Pollution Response amending the Detailed Rules previously issued by the China MSA which came into effect on 1 January 2012.

The Australian Government introduced increased penalties for pollution from ships and damage to the marine environment by way of new legislation – the Maritime Legislation Amendment Act, 2011 – that came into effect on 4 December 2011. The Act amends the Australian Navigation Act 1912 and the Protection of the Sea (Prevention of Pollution from Ships) Act, 1983.

The Regulation gives effect to the key provisions of the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea, 1974 as amended by the 2002 and extends the provisions of the Convention to certain categories of passenger ships engaged in domestic sea going voyages unless the Member State or EEA State takes steps to defer application of the Regulation to such voyages.

A further review has been undertaken of the areas approved by the US Coast Guard (USCG) for use in loading or lightening operations outside of both the Louisiana Offshore Oil Port (LOOP) and the four additional areas designated and approved for this purpose by the USCG, as outlined in the previous Circular.

The liquefaction of nickel ore cargoes has resulted in the sinking of a number of ships with a loss of many lives in the last 18 months. Nickel ore is a cargo which may liquefy if the moisture content of the material exceeds its Transportable Moisture Limit (TML). Cargo liquefaction may lead to a loss of stability, to the extent that the ship may capsize.
