In spite of financial and economic uncertainty, we are pleased to report that as at 20 August 2022, on a consolidated basis, Gard P. & I. (Bermuda) Ltd. has improved its insurance performance significantly for the current year, while the investment losses reflect the challenging macro-economic situation.

On 19 September 2022, the EU amended its FAQs clarifying that the carriage of certain cargoes from Russia including coal and certain types of fertiliser (and related insurance) is not prohibited (under Council Regulation (EU) 833/2014) when the goods are being transported to non-EU countries. On 7 October 2022 the EU updated the FAQs.
Please note that even if the circular is a P&I Member Circular the content of the circular applies to all forms of insurance provided by the Gard group of companies.

The International Group of P&I Clubs is a member of the Maritime Research Institute of the Netherlands (MARIN) Top Tier project. The project has been established to examine and assess the causes of container losses arising from at-sea incidents onboard various sizes of container ships with a particular focus on ultra large ships.

On the 3 June 2022 the EU published its sixth package of sanctions against Russia. This Circular focuses on the measures in the sixth package of sanctions which impact on the transport and insurance of oil and petroleum products; and the prohibitions on transacting with Russian state-owned enterprises subject to the Article 5aa restrictions and as listed in Annex XIX of the Regulation.

The agreement between R3 and E-TITLE has dissolved, and ownership of the legal framework has reverted back to E-Title Authority Pte Ltd. In accordance with this change, the trading name will also revert back from Corda eBL to e-Title™.

On 17 March 2022 the UK Government published a General Trade Licence in part to clarify earlier amendments to the UK Russia (Sanctions) (EU Exit) Regulations. Specifically, the licence addresses the issue as to whether it is lawful under the Regulation for insurers and reinsurers domiciled or operating from the United Kingdom to provide insurance for vessels calling at Russian ports or transiting Russian territorial waters.

Since 2010, considerable sanctions’ activity has been directed at shipping and its supporting industries reflecting the fact that 90% of world trade involves the carriage of goods by sea. The purpose of this Circular is to draw Members’ attention to some of the recent deceptive practices employed by parties that are engaged in activities that offend the sanctions regimes operated by national governments and or supranational bodies such as the UN.

We are pleased to report that as at 20 August 2021 the financial position of Gard P. & I. (Bermuda) Ltd. and its subsidiaries, remains strong with a confirmed A+ rating by Standard and Poor’s. This is despite the half year result having been negatively affected by major claims falling within the International Group Pool, a continued impact of COVID-19, and an increase in own claims.

The International Group understands that some cargoes of iron ore fines intended for shipment from the port of Pepel have been stockpiled outdoors uncovered for a prolonged period posing a particular risk of liquefaction during the wet season. It is also understood that some cargoes intended for shipment from Pepel have previously been considered too low grade for export and have been left in uncovered stockpiles for prolonged periods. These are now being blended with higher grade materials for export.

Cover for the costs of diverting a ship for the purpose of enabling the repatriation of deceased crew members or other deceased persons on board, shall be granted retrospectively to all Members with effect as from 20 February 2021 and, going forward, insurance cover will include certain extra costs for diverting a ship for the purpose of enabling repatriation of deceased crew members or other deceased persons on board.
