We are pleased to report that as at 20 August 2020, on a consolidated basis, the financial position of Gard P. & I. (Bermuda) Ltd. and its subsidiaries remains robust and healthy. This is despite our half year results being negatively affected by several major incidents within the International Group Pool, and spread of the COVID-19 pandemic.

The United States has recently enhanced the sanction provisions targeting the construction of the NS2 and TurkStream pipeline projects and those who provide vessels and services in connection with either project.

A new revision to the People’s Republic of China Law on the Prevention and Control of Environmental Pollution by Solid Wastes (new Revision) enters into force on 1 September 2020. The Law imposes joint and several liability on both the carrier and importer for the return and disposal of the solid waste where the waste is prohibited and/or proper license has not been obtained, and significantly increases the fines that can be imposed for violations.

6/2020: US Global Maritime Advisory

On 14 May 2020 the US issued a Global Maritime Advisory aimed at a range of industry sectors including marine insurers such as P&I clubs and shipowners and charterers. The significance of the document lies in the fact that it represents an attempt by the US Government to set out the standards by which the marine industries will be judged if they are linked to sanctions breaking.

In line with their legal and regulatory obligations, all Clubs in the International Group maintain sophisticated sanctions compliance programmes and procedures. The ability to track vessels using their AIS has become an increasingly important part of Clubs’ sanctions compliance programmes. All International Group Clubs have now agreed a common minimum standard of tracking.

4/2020: Mexico alert – smuggling of illegal narcotics – risk of ship detention and crew arrest

Since July 2019, international shipping industry organisations have seen a number of cases where ships have been detained upon arrival in Mexican ports where illegal narcotics have been found on board. The ships' ports of departure were usually Ecuador, Colombia or Panama.

The Chinese Maritime Safety Agency recently published new Measures of Administration on Agreement for Ship Pollution Response Regime, which became effective on 1 March 2020. The International Group of P&I Clubs has received further clarifications and feedback on the new measures from the International Group's advisers in the PRC and from China MSA.

The International Group of P&I Clubs has approved CargoX, a system based on blockchain technology that is intended for creating, tracking, managing, storing, and transferring the ownership of documents using blockchain technology to enable carriers, shippers, consignees, endorses, banks, freight forwarders and other parties to issue, exchange and sign, a variety of supply chain encrypted documents with no need for a central server or registry.

In 2010 the International Group launched the P&I Qualification programme as a dedicated professional qualification providing high quality, sector-specific training in all aspects of P&I insurance to Club employees. The decision has now been taken to open the registration for the programme to everybody.

The Boards of Directors of Gard P. & I. (Bermuda) Ltd. and its subsidiaries have decided that there will be no general increase in the Estimated Total Call for 2020. The financial position of the Association remains strong and mutual P&I has for the first half year ending 20 August 2019 generated a surplus above the target level.

On 5 August 2019, the United States (US) administration increased its sanctions programme against the Government of Venezuela, when President Trump issued Executive Order 13884 which blocks all property in the US of the Government of Venezuela, and prohibits US persons from engaging in any transaction with the Government of Venezuela. Also, on the same day, a number of General Licenses were issued, which appliy directly to US persons. Our Member Circular looks at the impact of Venezeula sanctions on P&I cover.

The United States Treasury Department’s Office of Foreign Assets Control has now published a “Framework for OFAC Compliance Commitments” setting out OFAC’s views of the essential elements of an effective economic sanctions compliance program.
